Welcome to LivinCart and Services Private Limited (“LivinCart”, “Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, Products, and interior service offerings (collectively referred to as the “Services”). By accessing, browsing, registering, or using the LivinCart Platform, you acknowledge that you have read, understood, and agreed to abide by these Terms. If you do not agree with any part of these Terms, you are advised not to use or access our Services.

1. SERVICES

LivinCart offers a range of home improvement and furnishing solutions, including home décor items, furniture, lifestyle products, and interior design–related services such as installation, renovation, home customization, and professional technician visits. We also provide same-day or scheduled delivery in selected serviceable locations.

We reserve the right to update, enhance, modify, or discontinue any part of the Services at any time, without prior notice. Such changes may include but are not limited to improvements in functionality, new service offerings, updates in technology integration, or discontinuation of older features.

2. WEBSITE

2.1 Content, Intellectual Property, and Third-Party Links

The LivinCart website and mobile application (“Platform”) provide access to information, marketing materials, service details, and Product descriptions in addition to offering Products

for sale. Some content displayed on the Platform is created by LivinCart, while certain information may be sourced from third-party vendors, partners, or publicly available resources. Where content is created by LivinCart, it is protected under applicable intellectual property laws of India and relevant international jurisdictions. Unauthorized copying, reproduction, modification, distribution, or commercial use of such content may lead to violation of copyright, trademark, and other proprietary rights.

All content made available on the Platform is provided strictly for personal, non-commercial, and lawful use. Any third-party links provided on the Platform are included solely for convenience. LivinCart does not endorse, control, guarantee, or take responsibility for the content, availability, accuracy, or safety of these external websites. Accessing third-party sites through our Platform is done entirely at your own risk, and LivinCart shall not be liable for any damage, loss, or consequences arising from your reliance on such external content or links.

2.2 Use of Website

You agree that your use of the LivinCart Platform is entirely at your own risk. LivinCart will not be held liable for any damages—direct, indirect, incidental, consequential, or otherwise—arising from your use or inability to use the Platform.

By accessing or using the Platform, you agree that you shall:

1. Comply with all applicable local, state, national, and international laws and regulations, including those governing intellectual property, data protection, and consumer rights.

2. Not engage in any activity that interferes with, disrupts, or negatively affects the experience of other Users or the operation of the Platform.

3. Not reproduce, sell, resell, copy, exploit, or commercially distribute any materials, information, or Products from the Platform without explicit written authorization.

4. Not engage—directly or indirectly—in sending unsolicited messages, spam, bulk emails, chain letters, promotional messages, or other disruptive communications.

5. Not defame, harass, abuse, stalk, threaten, or otherwise violate the rights of other Users, LivinCart staff, or associated personnel.

Any misuse or unlawful activity may result in immediate suspension or termination of access to the Platform.

3. ACCOUNT CREATION

To place an order or book any service, Users must create an account on the LivinCart Platform and provide accurate, complete, and verifiable information. You are responsible for safeguarding your login credentials and ensuring that no unauthorized person gains access to your account.

Any activity that occurs under your account shall be deemed to be your responsibility. LivinCart reserves the right to suspend, restrict, or terminate accounts that show suspicious behavior, fraudulent activity, misrepresentation, or violation of these Terms.

4. USER CONTENT

“User Content” refers to any reviews, photographs, messages, feedback, comments, or other forms of data submitted or uploaded by Users on the LivinCart Platform.

By submitting User Content, you grant LivinCart a non-exclusive, worldwide, transferable, royalty-free license to use, reproduce, modify, distribute, display, and publish such content across our digital and promotional channels. You must ensure that your content is lawful, genuine, and does not infringe upon any intellectual property or privacy rights of third parties.

LivinCart retains the right to remove or moderate any User Content that is inappropriate, offensive, misleading, or violates these Terms.

5. CONSENT TO USE DATA

By using the LivinCart Platform, you consent to the collection, processing, storage, and sharing of your personal information including contact details and payment-related data. This

information may be shared with delivery partners, service technicians, manufacturers, vendors, and logistic providers strictly for fulfilling your order or service request.

You also agree to receive communications from LivinCart through SMS, email, phone calls, WhatsApp, and push notifications regarding orders, appointments, service reminders, promotions, and updates.

All personal information is handled in accordance with our Privacy Policy.

6. BOOKINGS

For interior design, installation, and home services, bookings are subject to technician availability, geographical serviceability, and timing constraints. Estimated service timings provided on the Platform may vary based on workload, location, and operational limitations.

You must provide precise address details and ensure safe and unobstructed access to your premises for our service personnel. Any cancellation, delay, or rescheduling of booked appointments may attract applicable charges as per the Cancellation and Rescheduling Policy.

7. PRICING, FEES, AND PAYMENT TERMS

All prices displayed on the LivinCart Platform are in Indian Rupees (INR) and may be revised at any time without prior notice based on market conditions, vendor pricing, logistics costs, or product availability.

Applicable taxes, delivery charges, installation fees, and service charges may be added depending on the nature of your order. Payment methods may include UPI, credit/debit cards, net banking, mobile wallets, and cash on delivery (if applicable).

LivinCart reserves the right to cancel any order in case of suspected fraudulent transactions, payment failures, incorrect pricing updates, or breach of these Terms.

8. CUSTOMER CONDUCT

Users of the LivinCart Platform agree to conduct themselves in a lawful, responsible, and respectful manner at all times. You shall not misuse the Platform, attempt to gain unauthorized access, impersonate any other individual or entity, or engage in any activity that is deceptive or fraudulent. Unauthorized resale, commercial exploitation, or redistribution of LivinCart products, services, or content is strictly prohibited. Users must not intentionally damage any products, tools, equipment, or property during delivery, installation, or service visits, nor interfere with the proper performance of services. Any form of harassment, abuse, intimidation, threats, or unlawful conduct directed toward LivinCart employees, technicians, delivery personnel, partners, or representatives is expressly prohibited. Violation of any of these conditions may, at LivinCart’s sole discretion and without prior notice, result in suspension, restriction, or permanent termination of access to the LivinCart Platform, along with any other legal remedies available under applicable laws.

9. THIRD-PARTY SERVICES

LivinCart collaborates with independent vendors, manufacturers, logistics companies, technicians, and service providers. While we make every effort to ensure reliable service delivery, LivinCart shall not be held liable for failures, delays, or damages resulting from the actions, omissions, or negligence of third-party partners.

However, we will extend reasonable support to facilitate issue resolution between Users and such third-party partners.

10. YOUR RESPONSIBILITIES

As a user of the LivinCart Platform, you agree to provide accurate, complete, and up-to-date information while placing orders or booking services to ensure smooth processing, timely delivery, and correct service execution. You are responsible for carefully inspecting all products at the time of delivery or installation and must promptly report any visible defects, damages, or discrepancies as per our return or complaint procedures.

You further agree to ensure that the service or installation location is safe, accessible, and adequately prepared for technician visits, including the availability of required utilities, clear access paths, and a secure working environment. Users are expected to use, handle, and maintain all products strictly in accordance with the instructions, manuals, and care guidelines provided by LivinCart or the manufacturer, as improper usage may affect product performance, warranty, or service eligibility.

Additionally, you agree to make full and timely payments for all products purchased and services availed through the LivinCart Platform, including applicable taxes, delivery charges, and service fees. Failure to comply with these responsibilities may result in service delays, order cancellation, additional charges, or limitation of access to certain features of the Platform, as permitted under applicable laws and LivinCart policies

11. OUR INTELLECTUAL PROPERTY

All intellectual property including the LivinCart brand name, logos, product images, marketing material, website content, layouts, graphics, and software belong exclusively to LivinCart. No User may copy, reproduce, distribute, modify, or commercially exploit any part of the LivinCart intellectual property without explicit written approval.

Unauthorized use will be treated as a violation of intellectual property laws.

12. TERM AND TERMINATION

These Terms remain effective as long as you maintain an active account on the LivinCart Platform. LivinCart may terminate or restrict platform access at any time if you violate these Terms, engage in fraudulent behavior, misuse the Platform, or interfere with our operations.

You may request account deactivation at any time; however, all pending dues, service requests, or orders must be completed before your account is closed.

13. DISCLAIMERS AND WARRANTIES

LivinCart provides its Services on an “as-is” and “as-available” basis. We do not warrant uninterrupted access, error-free operation, or absolute accuracy of information displayed on the Platform.

Product images may slightly differ from actual Products due to lighting, texture, manufacturing variations, or display settings. Interior services depend on material characteristics, site conditions, and customer-selected specifications; hence outcomes may vary.

LivinCart is not liable for delays caused by weather conditions, transportation issues, vendor shortages, third-party failures, or unforeseen operational difficulties.

14. INDEMNITY

You agree to indemnify, defend, and hold harmless LivinCart, its affiliates, directors, officers, employees, partners, contractors, and service providers from and against any and all claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the LivinCart Platform. This includes, without limitation, any misuse of the Platform, any breach or violation of these Terms and Conditions, infringement of any third-party intellectual property, proprietary, or privacy rights, and any damages, injuries, losses, or incidents that occur during delivery, installation, or service visits as a result of your actions, omissions, negligence, or failure to comply with safety instructions or applicable laws. This indemnification obligation shall survive termination or expiration of your use of the Platform and services.

15. JURISDICTION, GOVERNING LAW, AND DISPUTE RESOLUTION

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall fall under the exclusive jurisdiction of the courts located in Visakhapatnam, Andhra Pradesh, unless otherwise mutually agreed.

LivinCart encourages users to first attempt resolution through customer support before pursuing legal action.

16. MODIFICATIONS

LivinCart reserves the full right, at its sole discretion, to update, revise, enhance, modify, suspend, or discontinue any aspect of the Platform, including but not limited to website features, mobile application functionality, Product pricing, availability, service options, promotional offers, or operational processes at any time without prior notice. Such modifications may be undertaken to improve performance, comply with legal requirements, incorporate technological advancements, or respond to market trends.

Users acknowledge that continued use of the Platform after any modification constitutes acceptance of the updated Terms or Service changes. LivinCart shall not be liable to Users or any third parties for any modification, suspension, interruption, unavailability, or discontinuation of the Platform or Services, whether temporary or permanent.

17. BILLING & ACCOUNT INFORMATION

LivinCart reserves the absolute right to refuse, reject, hold, or cancel any order at our discretion. We may impose limitations on order quantities made by an individual User, household, or account. These limitations may also apply to orders placed using the same billing or shipping address, payment method, or device identification.

Should an order be cancelled or modified due to stock issues, pricing errors, fraud detection, or any internal review, LivinCart may attempt to notify you using the email address, phone number, or billing information provided at the time of the order.

Users agree to provide accurate, complete, and current account information at all times, including email address, delivery address, contact details, and valid payment information. You also agree to promptly update account details—including credit/debit card numbers, expiration dates, UPI IDs, or billing addresses—to ensure uninterrupted service. Any incorrect or outdated information may result in delayed orders, failed deliveries, or cancellation of transactions.

LivinCart shall not be responsible for losses, delays, or service failures arising from inaccurate information provided by the User.

18. DOMESTIC USE

LivinCart makes no representation that its Platform, Products, or Services are appropriate, available, or permissible for use outside India. Users who access the Platform from international locations do so at their own initiative and risk, and are solely responsible for complying with all applicable local, state, national, and international laws, rules, and regulations pertaining to online purchases, product importation, and service availability.

Products purchased from LivinCart are designed and manufactured to meet Indian standards and specifications. LivinCart shall not be liable for issues arising from international usage, including electrical compatibility, warranty coverage limitations, or customs restrictions. Any shipment or export of Products outside India is undertaken entirely at the responsibility and cost of the User.

19. ASSIGNMENT

You may not assign, transfer, delegate, or otherwise dispose of any of your rights or obligations under these Terms without obtaining prior written consent from LivinCart. Any attempted assignment or transfer by the User without such consent shall be deemed invalid and unenforceable.

LivinCart, however, retains the unrestricted right to assign, transfer, or subcontract any or all of its rights and responsibilities under these Terms to any affiliate, subsidiary, third party, or successor entity—whether in connection with a merger, acquisition, restructuring, asset sale, or

otherwise—without requiring prior notice or consent from Users. Such assignment shall not affect the validity or enforceability of these Terms
